Extension of Time for Fulfillment of Obligation of Unpaid Annuity Fees

As you may be aware that the Directorate General of Intellectual Property had issued a Circular Letter on Fulfilment of the Obligation for Unpaid Patent Annual Fees on August 16, 2018, and Notification (Reminder) regarding the Deadline of Circular Letter of Directorate General of Intellectual Property dated August 5, 2019, wherein the Circular Letter is requesting the Patent Holder(s) who still have unpaid annuity fees for the abandoned patent cases prior to August 26, 2016, to settle up all of the unpaid annuity fees within the deadline of August 17, 2019.

The Circular Letter on Fulfilment of the Obligation for Unpaid Patent Annual Fees is an implementation of the provision of Article 88 and Article 115 and their elucidations in Indonesian Patent Law No. 14 of 2001 as well as for the orderly administration of financial statements for years 2016 to 2017 in connection with the existence of unpaid annuity debts of patent annuity fees by Patent Holder(s).

In other words, the abandoned patent cases which fall into the category of the above unpaid annuity fees are only for the abandoned patent cases under the regulation of the Indonesian Patent Law No. 14 of 2001

Further, since the deadline for fulfilling the obligation of unpaid annuity fees has passed, we hereby inform you that according to the information received from the Patent Office, it is allowable for the Patent Holders to obtain an extension of time to fulfil the obligation of unpaid annuity fees under the following terms :

  • The Patent Holders should submit a Commitment Letter stating that they will fulfil the obligation of unpaid annuity fees at the latest on January 31, 2020.
  • The Patent Holders are given a period of time to fulfil the unpaid annuity fees until July 31, 2020.

In this regards, we highly advise you to check your database on the unpaid annuity fees of the abandoned patents and attend to the debts prior to July 31, 2020 deadline to avoid any rejection to Patent Holder(s)’ new patent applications.

Please be advised that the DGIP shall not further process the new patent applications filed by the respective Patent Holder(s).
