Indonesian Decacorn and It’s Founder Sued for IDR 24.9 Trillion Over Alleged Copyright Violation

Hasan Azhari alias Arman Chasan sued PT Aplikasi Karya Anak Bangsa (Gojek) and Nadiem Makarim for alleged copyright violation to the Commercial Court Jakarta, on December 31, 2021.

Arman claims to be the inventor of the first online motorcycle taxi (Ojek Online) business model in Indonesia. That was the reason that made him file the lawsuit and asked for compensation from Nadiem and his company.

After having checked into the online court information system portal of the  Commercial Court Jakarta, Arman Chasan seeks compensation of IDR 10 billion and royalties of IDR 24.9 billion. He also requested that the compensation decision be implemented first even though the defendant filed a legal effort or cassation (uitvoerbaar bij voorraad).

Currently, the case is still rolling in the Central Jakarta District Court. The inaugural trial was held on January 13, 2022, and the hearing of the defendant’s answer is scheduled to be held on January 27, 2022.

Who is Arman Chasan and how can he sue Gojek?

Quoting Kompas, Friday (21/1/2022),  This man turned out to have gone viral in 2008, when he marketed ojek online services through a blog namely ojekbintaro.blogspot.com.

His breakthrough then attracted media attention until it appeared on television. Not only national TV, the English edition of NHK Japan station even did special coverage about Arman’s business.

Based on the Directorate General of Intellectual Property (DGIP) online database, there are five types of copyright for papers and computer programs that have been published since 2008 and recorded simultaneously with the DJKI, throughout 2020 and 2021.

Arman’s attorney even claimed that Nadiem Makarim had contacted his client to discuss the ojek online business scheme and promised to meet. Unfortunately, the meeting never took place since one of the parties was absent from the agreement.

Until this present time, there has been no news regarding the details of the dispute. However, in this trial process, Arman as a plaintiff must prove his claim if he has a legal basis. Likewise, Gojek as a defendant must prove that the plaintiff’s material is not true and that it has not violated copyright.
